These Terms of Service ("Terms") govern your use of the Codik mobile application and the website at itcodik.com (together, the "Service"), operated by IE Martynov Evgeny Igorevich (TIN 575310590533, OGRNIP 325570000000711), located at 302027, Russia, Orel region, Orel, Matveeva st., 14, apt. 18 (hereinafter, the "Company", "we", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

1.1. These Terms constitute a legally binding agreement between you ("User") and the Company.

1.2. You must read and accept these Terms before using the Service. If you do not agree with any part of these Terms, you must not use the Service.

1.3. We reserve the right to modify these Terms at any time. The updated version will be posted on this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. DESCRIPTION OF SERVICE

2.1. Codik is an interactive educational platform that provides access to programming courses, learning materials, coding exercises, projects, competitions, and AI-assisted learning tools.

2.2. The content is provided on an "as is" basis and may contain errors, inaccuracies, or outdated information. The Company does not guarantee the completeness or accuracy of educational content.

2.3. The Service is available via the website at itcodik.com and through mobile applications for Android and iOS.

3. USER ACCOUNTS

3.1. Registration may be required to access full functionality of the Service.

3.2. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.4. You must notify us immediately at support@itcodik.com if you suspect any unauthorized access to your account.

3.5. The Company may suspend or terminate your account if you violate these Terms or engage in fraudulent or illegal activity.

4. SUBSCRIPTION AND PAYMENTS

4.1. The Service offers both free and premium (paid subscription) features. Premium features are described in the relevant section of the Service.

4.2. Subscription terms, pricing, and available features are displayed in the Service and may vary by region, platform, or payment method.

4.3. Subscription is voluntary. Payment is processed through our payment provider (CloudPayments). Full subscription terms are detailed in our Subscription Agreement.

4.4. You may cancel your subscription through the support chat available on the website or in the mobile application, no later than 24 hours before the end of the current billing period.

5. COMPETITIONS AND PRIZES

5.1. Users may participate in competitions and leaderboard challenges offered through the Service.

5.2. The Company reserves the right to modify competition rules, schedules, prizes, or to cancel competitions at any time without prior notice.

5.3. Participation in competitions is voluntary and subject to applicable rules posted within the Service.

6. USER CONDUCT

6.1. You agree not to:

• Use the Service for any illegal activity or to distribute prohibited content
• Infringe upon the rights of third parties, including intellectual property rights
• Attempt to disrupt, damage, or interfere with the operation of the Service
• Share your account credentials or allow unauthorized access to your account
• Use automated tools (bots, scrapers) to access the Service without prior written consent
• Upload malicious code or content that could harm the Service or other users

6.2. You agree to comply with all applicable laws and regulations in your jurisdiction.

9. AI-GENERATED CONTENT

9.1. The Service includes an AI assistant (Codik AI) that provides educational guidance and recommendations.

9.2. Responses generated by Codik AI are for informational and educational purposes only and should not be construed as professional advice.

9.3. The Company does not guarantee the accuracy or completeness of AI-generated content. You use it at your own discretion and risk.

10. LIMITATION OF LIABILITY

10.1. To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

10.2. The Company's total liability, if any, shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10.3. The Company is not liable for any downtime, data loss, or service interruptions caused by factors beyond its reasonable control, including but not limited to cyberattacks, natural disasters, or third-party service failures.

11. INDEMNIFICATION

11.1. You agree to indemnify, defend, and hold harmless the Company from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1. These Terms are governed by and construed in accordance with the laws of the Russian Federation.

12.2. Any disputes arising from these Terms shall first be addressed through good-faith negotiation. If a resolution cannot be reached within 30 days, disputes shall be resolved in the courts of the Russian Federation at the Company's registered address.

12.3. Nothing in these Terms affects your statutory consumer rights under the laws of your country of residence, where such rights cannot be waived by agreement.

13. CHANGES TO THESE TERMS

13.1. We may modify these Terms at any time. Material changes will be communicated via email or through the Service at least 14 days before they take effect.

13.2. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you disagree, you must stop using the Service and notify us at info@itcodik.com.

14. SEVERABILITY

14.1. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
